Single Status Apostille

Do you need to apostille a Single Status?

Are you planning to get married in another country and have been told to apostille a document that states you are currently not married?

If you are planning to get married in another country who is a member of the Hague Apostille Convention, you will be asked to apostille a document called a Single Status.

This document may also be referred to as:

Here is an example of a single status affidavit:

The first step is to contact the local County Clerk’s office to request a document that states you are currently not married (AKA: Single Status).  Some County Clerk offices may refer to this document as a “Certificate of No Public Record” instead of a “single status”.  Most all County Clerk offices can provide you this document so please be sure to speak to a supervisor if you are told otherwise.  A document issued from the County Clerk’s office does not require notarization.

If the County Clerk’s office is unable to assist you and you are in the United States, you can use the sample above to write your own single status affidavit.  Basically, you are writing a sworn statement stating that you are currently not married to another person in the United States.  Be sure to have this document signed and notarized before you mail it in to our office. You should also check with the people requesting your single status if they will accept a sworn affidavit directly from you.

If you are outside of the United States, the local US Embassy or US Consulate office should be able to assist you in completing a single status and also having it signed and notarized.  The US Embassy or Consulate office should have a same.

Apostille Expiration – Does an Apostille Expire?

Common questions we receive are, “Does an apostille expire?”  “How long is an apostille valid for?”

An apostille does not have an expiration date.

Countries who are members of the Hague Apostille Convention may request your documents (Example: Birth, Marriage, power of attorney, Divorce Decree, Death, etc..) to be recently issued with an apostille. For example, most countries request an FBI apostille be issued within the past 90 days. Some countries may have even more stringent requirements and may request a background check issued within the past 30 days with an apostille.

However, you may find that some countries request that apostille is no more than 3, 6, or 12 months old.

Please double check with the country requesting your documents in order to find out how old your documents can be before you mail them in for processing. For example, if you need a California apostille on a California birth certificate, we recommend that you ask how old the birth certificate can be and how recent the apostille should be issued. If the answer is 30 days for both, then the birth and the apostille must be issued within the past 30 days.

From our experience, State and Federal (FBI) background checks have the most restrictions.

Also, some States have restrictions on how old the document can be.  For example, documents issued from the States of Wisconsin and Virginia must be issued within the past 12 months. Most documents from Texas and Illinois must be within the past seven years. We recommend that you contact us so we can discuss your documents.

China Embassy Legalization Washington DC

In order to process your documents for China, you will need to mail in your signed and notarized diploma and your FBI background check.  In order to have your diploma signed and notarized, you will need to contact the University and request your diploma to be signed by the Registrar and notarized by a notary public.  The notary public must notarize the signature and name of the Registrar.

Cuba Embassy Legalization

In order to process your documents for Cuba, you will need to provide a certified Spanish translation of each of your documents.  The translation will need to be provided by a certified translator.  We recommend that you hire a translator who is a member of the American Translator’s Association.  The translator will need to attest to the translation, sign it, and have a notary public notarize the signature.  Once the document has been certified by the State, the certificate, document, and Spanish translation needs to be bound by the US Department of State before it’s submitted to the Embassy.
